Sale Agreement
When you shop on oiamperformance.com or place an order with us, you are accepting the terms of the following Sale Agreement.

This Sale Agreement is a legal contract between the Customer and oiamperformance.com. The Customer accepts this Sale Agreement by making a purchase, placing an order, or otherwise shopping on the Site. (References to "you" or "your" shall relate to the Customer; references to "oiamperformance.com" shall relate to oiamperformance.com.) The terms and conditions of this Sale Agreement are subject to change without prior notice, except that the terms and conditions posted on the Site at the time the Customer initially places or modifies an order will govern the order in question.

This Sale Agreement constitutes the entire agreement between the Customer and oiamperformance.com relating to the purchase or sale of goods or services on the Site. The Sale Agreement may only be modified or terminated with regard to goods or services that have been purchased or sold on the Site in a writing signed by oiamperformance.com. Electronic records that are otherwise valid, shall be accepted under the Sale Agreement. The Customer consents to receiving electronic records, which may be provided via a web browser or e-mail application connected to the Internet; consumers may withdraw consent to receiving electronic records or have the record provided in non-electronic form by contacting oiamperformance.com at the address provided below.

In the event of any conflict between the terms and conditions stated on your purchase order and this Sale Agreement or any terms and conditions on our invoice, you agree that the provisions of this Sale Agreement and our invoice shall control.

Loyalty Program
The customer understands the OIAM Rewards loyalty program is made available as a means of thanking paying customers for continuing to do business with OIAM. Abusing this program by any means is considered a violation of the Site Terms of Sale. Violators will be prosecuted to the fullest extent of the law.

SMS Marketing & Other Communications

By consenting to OIAM’s SMS marketing in the checkout and initializing a purchase or subscribing via our subscription tools, you agree to receive recurring text notifications (for your order, including abandoned checkout reminders), text marketing offers, and transactional texts, including requests for reviews from us, even if your mobile number is registered on any state or federal do-not-call list. Message frequency varies. Consent is not a condition of purchase.

If you wish to unsubscribe from receiving text marketing messages and notifications, reply with STOP to any mobile message sent from us or use the unsubscribe link we provided you within any of our messages. You understand and agree that alternative methods of opting out, such as using alternative words or requests, will not be considered a reasonable means of opting out. We do not charge for the service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.

We have the right to modify any telephone number or short code we use to operate the service at any time. You will be notified on such occasions. You agree that any messages you send to a telephone number or short code we have changed, including any STOP or HELP requests, may not be received, and we will not be liable for honoring requests made in such messages.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

State Sales Tax
Because OIAM maintains a physical presence in Wisconsin, the company is required by law to add a 5.0% sales tax to orders placed by customers residing in the state of Wisconsin.

OIAM also has a physical presence in the state of Tennessee. Customers shipping to the state of Tennessee will have a 9.25% sales tax added to their online order.

For states in which an online retailer does not have to collect sales tax, it is the customer's responsibility to pay the tax - in which case it is known not as a sales tax but a "use tax" instead. Please visit the Department of Revenue online for more information regarding use tax and how it may apply to your order.

Governing Law
This agreement and any sales hereunder shall be governed by the laws of the states of Wisconsin and Tennessee without regard to conflicts of laws rules. You the customer consent to the jurisdiction of the Federal or State courts located in Outagamie County, WI and/or Williamson County, TN for the purposes of any suit or legal action arising from this sale agreement.
